In the cases indicated in the previous sentence, you also provide your consent to the collection and use for the purposes of the website and the legal relationships determined by it of the personal information provided by you.
The binding of the General and Special Conditions is applicable both to the current configuration of the website and to all changes made to it in the form of additions and amendments or introduction of new menus, categories, sections and others. 1).The present General Terms and Conditions represent a contract for provision by "HOMELY BULGARIA" DZZD (EIC 177361480), with registered office and address of management: Haskovo city, "Otets Paisiy" street No. 25-27; floor 2 office 3,4, e-mail: info@homely.bg, on its own website Homely.bg, for the implementation of virtual services and regulate the rights and obligations of the users of the website Homely.bg (Users), owned by "HOMELY BULGARIA" DZZD.
2).Parties to this contract are "HOMELY BULGARIA" DZZD (EIC 177361480), on the one hand, and every User who has loaded the Homely.bg website.
3).The user declares that he is familiar with the present General Terms of Use and that any active action on his part or retention of passive behaviour after the Homely.bg website is loaded in the browser constitutes an express electronic declaration of consent within the meaning of the Law on Electronic document and the electronic signature that he agrees with these General Terms of Use.
4).An active action is clicking/pressing/selecting an electronic link or button on the Homely.bg website.
5).Keeping passive behaviour means not leaving the website after it has loaded in the User's browser.
6).By accepting these General Terms and Conditions, the User expressly consents to his personal data being processed by "HOMELY BULGARIA" DZZD in compliance with the requirements of the Personal Data Protection Act - both in relation to these General Terms and Conditions and the use of the Internet the website Homely.bg, as well as on the occasion of the activity of "HOMELY BULGARIA" DZZD.
7).The services of the site are intended for persons over 18 years of age. If the User is a minor, he may not use the Services without the express written permission of a parent or guardian. The use of the site without such permission is contrary to these General Terms and Conditions and constitutes hiding important information and misleading the Administrator. In this case, the Administrator is not responsible for any circumstances or events arising as a result of this misrepresentation by the User.

Interface – a combination of graphic objects associated with program code, through which the User communicates with the Internet site in a way accessible to him;
Platform – a set of conceptual, programming and graphic solutions, making up a complete product, providing an accessible environment for the User to the possibilities of the Internet space;
Browser - a software program for a computer, smartphone or other device, providing the ability to transfer, process and visualise data using various types of data transfer protocols;
An electronic link is a link indicated in a particular Internet page that allows automated referral to another Internet page, information resource or object through standardised protocols;
Malicious actions or omissions that violate Internet ethics or cause harm to persons connected to the Internet or associated networks, sending unsolicited mail (unsolicited commercial messages, SPAM), gaining access to resources with foreign rights and passwords, using flaws in systems for personal gain or information extraction (HACK), performing actions that can be qualified as industrial espionage or sabotage, damaging or destroying systems or information arrays (CRACK), sending "Trojan horses" or causing the installation of viruses, or remote control systems, disturbing the normal work of other Internet users and associated networks, performing any actions that can be qualified as a crime or an administrative violation under Bulgarian legislation or under other applicable law;
Information system / System is any individual device or set of interconnected or similar devices, which, in the execution of a certain program, provides automatic data processing;
Internet page within the meaning of these General Terms and Conditions means a constituent and separate part of a website;
IP Адрес ("IP address") is an identification number associating a computer device, Internet page or resource of the User in a way that allows its localization in the global Internet network;
A random event is an unforeseen circumstance at the time of the conclusion of the contract, which makes the provision of services objectively impossible;
Website / site ("website") is a designated place in the global Internet network, accessible through its unified address (URL) under the HTTP, HTTPS or other standardised protocol and containing files, programs, text, sound, picture, image or other materials and resources;
Voucher or receipt with promo code – official name Homely voucher - a virtual document with a unique number and a secret code, issued to the user - buyer by "HOMELY BULGARIA" DZZD, as an administrator of the Homely.bg site, acting under the authority of a trader or a representative of a company, in confirmation of the fact that under the terms of Article 48 of the Law on Consumer Protection, the consumer-buyer has entered into a specific contract for a price discount with a specific merchant or representative of a company, through the information platform Homely.bg and the electronic form located there of goods/services, at prices announced by the trader, as well as that he made a payment for a service made in favour of "HOMELY BULGARIA" DZZD according to the terms of the contract concluded between them, by transferring it to the account of the administrator of the Homely.bg site.
Special conditions - general conditions in a separate User (e.g. Conditions for servicing transactions with bank cards, etc.);
Cookies - Cookies - small text files used in accordance with the Cookie Policy to store small bits of information locally in the User's browser/device, with the aim of correct functioning of the Site and providing the best possible services.

1)."HOMELY BULGARIA" DZZD provides for the use of Users a platform for online design services through its website Homely.bg, under the conditions of a contract for distance sales within the meaning of Art. 45 et seq. of the Consumer Protection Act, exercising the powers conferred upon him by virtue of this contract.
2).The contract for distance sales, through which the User purchases services using the platform provided by "HOMELY BULGARIA" DZZD, is different from these General Terms and Conditions, as when making an electronic statement to conclude the contract for purchase and sale, the User agrees both with these General Terms and Conditions and with the content of the distance sales contract providing for payment, prominently available in the sales interface.
3)."HOMELY BULGARIA" DZZD maintains the website Homely.bg and provides design services through the page, and is not responsible in the following cases:
- For damages caused by improper behaviour of traders participating in the program for providing discounted goods/services promoted through the website owned by "HOMELY BULGARIA" DZZD, or third parties, subcontractors on the Homely.bg;
- For possible defects and/or other complaint liability regarding the goods/services purchased by the User through a Homely voucher or a receipt with a promo code provided by the site, as well as if conditions or prices in offers announced on merchant sites (participating in the program for) Homely voucher, prove to be wrong or misleading;
- For violation of copyright and related rights through the positioning of materials subject to these rights, provided by related merchants, promoters/or users of the services of the website owned by "HOMELY BULGARIA" DZZD;
- For damages caused by other sites accessible through links/banners placed on this site;
- For all damages caused to Users when providing the service, with the exception of intentionally caused damages (by employees of "HOMELY BULGARIA" DZZD);
- If the User forgets his device with an open browser on the page with his personal data filled in or in any other way allows and/or allows it to be used by third parties who abused his registration;
- For the damages caused by the purchase of goods/services offered through the Homely.bg site and/or by the action/inaction of the merchants selling them in connection with the provision of mandatory information to Users in accordance with the requirements of the Consumer Protection Act;
- For the damages that occurred in the absence or interruption of accessibility to the Homely.bg website, independent of the "HOMELY BULGARIA" DZZDteam.
4).The username with which the User registers does not give him any other rights, except the right to use the specific username within the information system of "HOMELY BULGARIA" DZZD. "HOMELY BULGARIA" DZZD does not verify and is not responsible for the authenticity of a user name, for whether it affects the rights of third parties and in particular the right to a name or other personal rights, the right to a trade name (company), the right to a trademark or other intellectual property rights.
5).The user undertakes when using the access granted to him to the electronic platform:
- to comply with Bulgarian legislation, applicable foreign laws, these General Terms and Conditions, Internet ethics, rules of morality and good manners;
- not to harm the good name of another and not to call for a violent change of the constitutionally established order, to commit a crime, to violence against the person or to incite racial, national, ethnic or religious enmity;
- not to preach fascist or other anti-democratic ideology;
- not to violate someone else's property or non-property rights, including intellectual property rights;
- to immediately notify "HOMELY BULGARIA" DZZD of any case of committed or detected violation;
- not to interfere with the proper operation of the system, including, but not limited to: not to thwart the identification procedure of another user, not to access outside of the one provided, not to damage or hinder the availability, reliability or quality of the access provided, as well as not to use it in a way that causes a refusal to use it;
- not to extract by technical means or in a technical way information resources or parts of information resources belonging to the databases located on the website of "HOMELY BULGARIA" DZZD "HOMELY BULGARIA" DZZD
- not to impersonate another person, or otherwise mislead third parties about his identity or his belonging to a certain group of people;
- not to commit malicious acts within the meaning of these General Terms and Conditions;
- to take all care and take the necessary measures that are reasonably necessary in order to protect your personal and bank data;
- not to upload, not to disclose in any way to third parties and not to provide "HOMELY BULGARIA" DZZD content - information, data, text, sound, files, software, music, video, photographs, graphics, audio materials , messages, as well as any other material or electronic references to material that:
- contradict Bulgarian legislation, applicable foreign laws, these General Terms and Conditions, Internet ethics, rules of morality and good manners;
- are the subject of intellectual property rights of third parties, except with the consent of the right holder.
6).Except in cases where it is expressly agreed, the User may not reproduce, change, delete, publish, distribute and publicise in any other way the information resources published on the website of "HOMELY BULGARIA" DZZD.
7).The User declares that by confirming these General Terms and Conditions and their sections (appendices), he is bound by the obligation to fulfil them both in his relations with the Site Administrator and in his relations with other Users arising as a result of the use of the site.
8).For unsettled cases in the contractual relations that arose between Users when concluding a contract between them through the use of the site, as well as in the event of a conflict between the clauses of a contract concluded between Users through the use of the site and the clauses of these General Terms and Conditions and their annexes , the terms of the General Terms and Conditions and their annexes shall apply, unless expressly stated otherwise.
9)."HOMELY BULGARIA" DZZD reserves the right to unilaterally terminate this contract, as well as at its discretion to prohibit further use of the website by him, without being responsible for any damages suffered or lost profits as a result, in the following cases:
- in case of violation of any of the rules included in these General Terms and Conditions and their annexes by the User;
- in case of suspicion of improper actions on the part of the User towards "HOMELY BULGARIA" DZZD or other Users;
- in case of suspicion of violation of provisions of the current legislation; - in case of provision of false or misleading data by the user;
- in other situations, at the discretion of "HOMELY BULGARIA" DZZD.
10).In cases where the User uploads photos, videos and other content to the "HOMELY BULGARIA" DZZD platform, he does so at his own risk, as he is obliged to arrange the copyright of the relevant materials himself, as well as the consent of the possibly photographed persons. For our part, we recommend not uploading photos and video materials containing images of individuals.
1)."HOMELY BULGARIA" DZZD takes due care and is responsible for protecting the information about the User, which became known to him on the occasion of the user's use of the site, except in cases of force majeure, accidental event or malicious actions of third parties.
2)."HOMELY BULGARIA" DZZD collects and processes information about Users only for the purposes provided for in these General Terms and Conditions and the Personal Data Policy.
3).By accepting these General Terms and Conditions, the User agrees to the processing of his personal data for the purposes of "HOMELY BULGARIA" DZZD, according to the Personal Data Policy, an integral part of the General Terms and Conditions.
4).By registering at Homely.bg the User consents to his personal data being used for the purpose of concluding a future contract. The User should bear in mind that if a purchase has already been made through a distance contract, the User will not be able to withdraw his consent to the processing of his personal data, processed for the purposes of the contract, and to be completely "forgotten" (all information to be deleted).
5).The user-buyer agrees that when concluding a distance sales contract, part of his personal data will be provided to the relevant merchant, for the purposes of implementing the relevant legal relations that have arisen. Such personal data are: Names, in certain cases - Telephone number and E-mail address.
1).By loading the Homely.bg site, the User gets the opportunity to familiarise himself with a published service in detail. In a prominent place on the title page, the User can familiarise himself with both the data of the company maintaining the Internet site and the data of merchants participating in the program with Homely vouchers at the moment, together with the General terms and conditions of use of the site.
2).By taking an active action, the User declares that he is familiar with the General Terms of Use of the site and unconditionally accepts them.
3)..In the event that the User wishes to conclude a contract through the platform provided to him, he should reach a page - a part of the site, containing a specially designed interface, through which the User will fill in information for the correct performance of a service by "HOMELY BULGARIA" DZZD and will execute the electronic declaration of intent to conclude a distance purchase and sale contract, with payment to the account of "HOMELY BULGARIA" DZZD.. The distance sales contract is considered concluded upon payment. For the amount paid, "HOMELY BULGARIA" DZZD issues to the User a virtual receipt ("Homely voucher with promo code"), confirming the payment made for the purchase of a service offered on the Homely.bg Hоmely.bg website.
4).Payment of the price under the contract is carried out by means of the methods comprehensively listed on the site, and making the payment is, on the one hand, a voluntary statement by the User that he agrees to pay for the service, and on the other hand, it represents an electronic declaration of will by the User that agrees with the General Terms and Conditions for the use of the site, as well as the General Terms and Conditions of Purchase and Sale, which he himself has read, approved and selected so far.
5)..After concluding the contract, the User receives at the e-mail indicated by him, a message about the successful acceptance of his electronic declaration of will, which is a confirmation that the contract has been concluded. From there on, the parties to the contract are governed by the General Terms and Conditions and the individual terms and conditions. In the event that a User-buyer receives a "Homely voucher" and does not take advantage of it under the conditions and deadline for presentation specified on the site, the User-buyer does not have the right to request a refund of the price paid by him, which remains for the design service performed by "HOMELY BULGARIA" DZZD. After the deadline for presenting the "Homely voucher" expires, the seller's responsibility for non-performance ceases. During the deadline, the buyer has the right to purchase a product/service with a discount (specified in the voucher) on a certain day or period after the expiration of the deadline for presentation.
1).In order to improve the quality of the services offered and to optimise the protection of the rights of the subjects in any legal relationship arising as a result of the use of the Homely.bg site, each User bound by the General and special conditions for use of the Homely.bg site gives consent "HOMELY BULGARIA" DZZD, in its capacity as the owner of the Homely.bg site, at its discretion, to record the telephone conversations of the Users of the Homely.bg site in their communication with each other, on the occasion of the occurrence, amendment or termination of any arising as a result of the use of site legal relationship. For this purpose, Homely.bg has the right, and the Users agree, to provide a communication channel through which the correspondence between the individual Users passes. The communication channel is realised by email from the Homely.bg system.
2).Users, accepting these General Terms and Conditions, agree that the data specified by them, through which contact can be made with them, will be used by "HOMELY BULGARIA" DZZD for sending messages and keeping correspondence about the status of those arising as a result of the use on the website Homely.bg legal relations.
1).Intellectual property rights on all objects of intellectual property - materials, databases, information received from users and other resources located on the website Homely.bg are subject to protection according to the Law on copyright and related rights and/or Law on Trademarks and Geographical Indications and belong to or have been made available for use by "HOMELY BULGARIA" DZZD and may not be used by any other person in violation of current legislation.
2).The intellectual property rights regarding the text and content of the banners of the published traders are provided for the use of "HOMELY BULGARIA" DZZD. The merchant declares that he is the holder of the copyright or has the right to use the relevant content, having acquired this right on a legal, contractual or other legal basis, as well as that the availability of this content on the website or its provision to "HOMELY BULGARIA" DZZD for placing the site does not violate the rights of third parties.
3).All elements of the content of the Homely.bg Website, including design, domain name, trademark, software systems, software as a service, databases, text, drawings, graphics, sketches, industrial design and other information or elements representing an object of intellectual property within the meaning of the Law on Copyright and Related Rights, the Law on Trademarks and Geographical Indications and the Law on Industrial Design, are the intellectual property of "HOMELY BULGARIA" DZZD or provided for the use of "HOMELY BULGARIA" DZZD.
4).Any use, reproduction, modification, public display and other similar actions of part or all of the author's content on the websites of "HOMELY BULGARIA" DZZD without the express prior written permission of "HOMELY BULGARIA" DZZD as the copyright holder (which legitimises the rights on the relevant product in an appropriate and generally accepted manner) is prohibited and will be prosecuted as provided by the applicable national and international legislation governing intellectual property.
5).The user has no right to save, copy or reproduce the source code, parts, elements or materials from the Homely.bg website without the express prior written permission of "HOMELY BULGARIA" DZZD.
6).Intellectual property rights on all materials and resources located on the Homely.bg website (including available databases, trademarks, industrial designs and others) are subject to protection under the Law on Copyright and Related Rights, Law on Trademarks and geographical indications, Industrial Design Law belong to "HOMELY BULGARIA" DZZD or are provided for the use of "HOMELY BULGARIA" DZZD and cannot be used in violation of the current legislation.
7).The possibility of using the services provided by "HOMELY BULGARIA" DZZD, does not include the right to copy or reproduce information and to use objects of intellectual property, unless it concerns insignificant in volume information intended for personal use, proviso that the legal intellectual property rights of "HOMELY BULGARIA" DZZD are not unjustifiably damaged and in the event that the copying or reproduction is carried out for non-commercial purposes, and when referring to it, it must be expressly stated that it was taken down from the Homely.bg website.
8).In the case of copying or reproduction of information beyond what is permissible, according to the previous paragraph, as well as in any other violation of intellectual property rights on the resources of "HOMELY BULGARIA" DZZD, the violator owes "HOMELY BULGARIA" DZZD a penalty in the amount of 50 000 (fifty thousand) BGN for each individual violation. The indicated amount of the penalty does not deprive "HOMELY BULGARIA" DZZD of the right to claim compensation for greater damages than the amount of the penalty.
9).Each User undertakes to comply with the Bulgarian legislation, the applicable foreign laws, the present General Terms and Conditions, Internet ethics, the rules of morality and good manners when using the Website "HOMELY BULGARIA" DZZD and its functionalities; not to harm the good name of others and not to call for a violent change of the constitutionally established order, to commit a crime, to violence against the person or to incite racial, national, ethnic or religious enmity, not to preach fascist or other anti-democratic ideology, not to violate someone else's property or non-property rights; to immediately notify "HOMELY BULGARIA" DZZD of any case of committed or detected violation; not to interfere with the correct operation of the system, including, but not limited to, not to thwart the identification procedure of another User, not to access and use outside of those provided, not to damage or hinder the availability, reliability or quality of the access provided, as well as to does not use it in a way that causes a refusal to use it; not to extract by technical means or in a technical way information resources or parts of information resources belonging to the databases located on the Homely.bg Website and thus not to create its own database in electronic or other form; not to impersonate another person or otherwise mislead third parties about his identity or his belonging to a certain group of people; not to commit Malicious actions within the meaning of these General Terms and Conditions.
10).By confirming these General Terms and Conditions, the User undertakes not to modify, adapt, translate, prepare derivative works, decompile, disassemble or otherwise attempt to obtain databases or the source code for the software services offered by "HOMELY BULGARIA" DZZD. The same prohibition applies to all attempts to access confidential information or documentation, create or attempt to create a substitute or similar service or product by using access to the system or company information related to rights of "HOMELY BULGARIA" DZZD. The user undertakes not to use in any way, remove, cover, or change copyright rights of "HOMELY BULGARIA" DZZD, trademarks, industrial designs or other intellectual property rights, included or related to any of the products or services offered by "HOMELY BULGARIA" DZZD.
11)."HOMELY BULGARIA" DZZD has the right at any time and without prior warning to suspend access to any content located on the site, which it considers to be contrary to the current Bulgarian legislation or to these General Terms and Conditions or to the rights or legitimate interests of third parties or the permissible moral norms, to stop, limit or change the services provided to the User, as well as to refer the competent state authorities, if with his behaviour the User, in the judgement of "HOMELY BULGARIA" DZZD, violates the provisions of the current Bulgarian legislation, of the present General conditions or the rights and legitimate interests of third parties.
12).When receiving notifications from Users and third parties that published content on Homely.bg violates their intellectual property rights, as well as in the event that the User violates an intellectual property right of "HOMELY BULGARIA" DZZD,"HOMELY BULGARIA" DZZD has the right at its discretion and without prior warning to suspend access to such content until such a dispute is resolved by an act of a competent state authority. Upon receipt of an order from competent state authorities regarding the content of the website, "HOMELY BULGARIA" DZZD has the right, without prior warning, to stop access to such content or to perform other actions, according to the received order.
13).In the event that Users or third parties consider that their intellectual property rights have been violated and wish to report an established violation of intellectual property rights related to content located on the Homely.bg platform, they should send a notification to the following address: info@homely.bg. The notification of the alleged violation must be in writing and have at least the following content:
а) Signature (including advanced or universal electronic signature) of the person or a duly authorised representative of the person - holder of the right that is allegedly infringed;
б) Power of attorney, in case the notification is submitted by proxy;
в) Specific indication of the content that is claimed to be infringing (in case infringement is claimed with respect to several materials - a comprehensive list of all materials), as well as indication of a precise URL allowing the identification of the content from "HOMELY BULGARIA" DZZD;
г) Information sufficient for "HOMELY BULGARIA" DZZD, to be able to contact the person who submitted the notification - such as full names, address, telephone and e-mail address;
д) A statement by the person submitting the notification that they have a good faith belief that use of the content in the manner described is not permitted by the holder of the intellectual property rights, its representatives and agents, or by law;
е) Declaration that the information in the notification is true and that the person submitting it is acting in his capacity as the holder of the right that is allegedly infringed, or his proper representative and, accordingly, evidence certifying the ownership of the rights;
"HOMELY BULGARIA" DZZD, at its discretion, undertakes the actions specified in these General Terms and Conditions.
1).Accepting the General Terms and Conditions, each User should be aware that he has no right of withdrawal from a contract concluded at a distance, in relation to the contracts:
- for the provision of services where the service has been provided in full and its implementation has begun with the express prior consent of the user and his confirmation that he knows that he will lose his right of withdrawal after the contract has been fully fulfilled by "HOMELY BULGARIA" DZZD;
- for the delivery of services made to the order of the user or according to his individual requirements;
- in which the user has expressly requested "HOMELY BULGARIA" DZZD to visit him at his home in order to carry out activities for filming, repair or maintenance;
- for the provision of digital content that is not delivered on a physical medium, when the performance has begun with the express consent of the user, who has confirmed that he knows that he will thereby lose his right of withdrawal.

2).All active applications form an integral part of these general terms and conditions.
3).By confirming the General Terms and Conditions, the User of the site confirms the acceptance of each of the attachments to them. By confirming any of the attachments to the General Terms and Conditions, the Site User confirms acceptance of the General Terms and Conditions themselves.
4)."HOMELY BULGARIA" DZZD reserves the right to change or supplement these General Terms and Conditions and their annexes unilaterally, without expressly notifying the User (unless the change significantly changes the legal framework)
5).By confirming these General Terms and Conditions, the User-buyer declares that he is aware of his rights under the General Terms and Conditions..
6).By confirming these General Terms and Conditions, the User-buyer declares his express consent to pay in advance, in full, the price of the purchase and sale contract concluded through this platform.
7).The parties declare that in case of invalidity of any of the clauses of these General Terms and Conditions and/or the annexes, this will not invalidate the contract, other clauses or its parts. The invalid clause will be superseded by the mandatory rules of law or established practice.
8).The provisions of the current legislation of the Republic of Bulgaria apply to all matters not settled by these General Terms and Conditions.
9).These General Terms and Conditions and/or their annexes may be revised and updated at any time by "HOMELY BULGARIA" DZZD. If the User continues to use the site, he expressly accepts and agrees with the changes made.
